Russ M. Herman is a Senior Partner of Herman, Herman, Katz & Cotlar, and Chairman of the Board of Directors of HermanGerel.
Mr. Herman graduated from Tulane University with a B.A. degree in 1963 and an L.L.B. degree (now called J.D.) in 1966.
In 1977, he was chosen "Outstanding Trial Lawyer" by the Louisiana Trial Lawyers Association, and was LTLA President from 1980 to 1981. Mr.
Herman has authored over 100 articles, papers and books in various aspects of civil trial practice and has been published in various works including Am Jur; Trials; Shepard's/McGraw Hill; The National Business Institute; Trial Magazine; The Forum; Trial Talk; Successful Trial Techniques of Expert Practitioners; and Personal Injury Annual by Matthew Bender.
Mr. Herman has lectured at Tulane University School of Law, Louisiana State University School of Law, Harvard Law School, Loyola University School of Law and Georgetown Law School. Mr. Herman continues to be a guest lecturer at seminars and conventions sponsored by the Louisiana Bar Association, Louisiana Trial Lawyers Association, the Association of Trial Lawyers of America, the American Bar Association, the
Practicing Law Institute and the National Business Institute, as well as more than 50 other state and national professional organizations. He is also a contributing editor of the Expert Witness Reporter
and Trial Diplomacy Journal.
Mr. Herman served as President of ATLA from 1989 to 1990, was president of the Civil Justice Foundation from 1987 to1988, and was president of the Roscoe Pound Foundation from 1991 to 1993. He is a Diplomat of the American Board of Professional Liability attorneys,
a Diplomat of the National College of Advocacy, a Fellow and Director of the International Academy of Trial Lawyers, a member of the American Board of Trial Advocates, and a Fellow of the International Society of
Barristers. In 1998, Mr. Herman received the Joe Tonahill Award, and in July of 1999 he received the ATLA Lifetime Achievement Award, and in July of 2001, the most prestigious honor ATLA bestows, the Leonard Ring Champion of Justice Award.
Mr. Herman is currently serving his second 3-year term as Chairman of the Railroad/Highway Crossing Accident Litigation Group of ATLA and has recently been elected Co-Chair of the ATLA Litigation Group relating to Rezulin. He has been selected for listing by
Naifeth and Smith in their book Best Lawyers in America in the personal injury and maritime trial practice areas.
Mr. Herman has appeared as a guest on such television programs as Good Morning America, the Today Show, and CNN Newsline, as well as several radio programs. His opinion editorials and interviews are regularly reported in the Washington Post, New York Times, The Wall Street Journal, National Law Journal, American Bar Journal and USA Today. He is the author and performer of ATLA's best selling, six-volume video trial practice series, Courtroom Persuasion: Art, Drama & Science, and a 443-page book by the same title published by West Group, Clark Boardman Thomson and ATLA Press. Mr. Herman is also the author of publishing's two-volume trial
practice book, Louisiana Personal Injury.
Mr. Herman is one of the country's lead counsel for anti-tobacco litigation and serves as counsel in a number of state class actions brought on behalf of
individual claimants and the Louisiana State Attorneys General suit to recover Medicaid benefits. Mr. Herman was a lead negotiator for plaintiffs in the $368 billion proposed settlement with the tobacco industry and on the private counsel team that recovered $4.6 billion for Louisiana through its Attorney
General, and $12 billion as part of the team representing the State of California.
Mr. Herman serves on the Ethics Panel for the United States District Court - Eastern District of Louisiana and was a contributing author of several chapters of the Louisiana Bench Book for District Court Judges on Complex Litigation: Ethics and Discovery.
The National Law Journal recently named Mr. Herman as one of Louisiana's top ten litigators and the American Law Journal highlighted him in its June 1999 issue in connection with his efforts in Handgun, Tobacco and HMO litigation. In the July 3, 2000, issue of Forbes Magazine, Mr. Herman is featured as one of the first attorneys to put together an alliance of lawyers to take on big companies.
Mr. Herman has a National Reputation in complex and class action cases. He has been appointed by various State and Federal court Judges as a leader or Chairperson of Plaintiffs committees in Product Liabilities, Fire and Explosions, Maritime, Securities, Insurance and Construction litigation.
He practices at the HermanGerel office in New Orleans, Louisiana.
